Good morning,

I apologize I have missed a few of your calls, as I had been off work and have been working at returning all the calls and emails I missed.

Previously, we had brought this matter to the Elder’s Advisory. You asked who was on this committee and the following are members that comprise the Elder’s Advisory Committee:

·         James Johnny

·         Max Settler

·         Bill White

·         Jerry Brown

·         Gary Manson

·         Joe White

·         Joe Wyse

·         Late Jack Seward – replaced with his son “birdie”

·         William Good

If I have misses anyone, the fault is mine and unintended.

To date, I have not been able to provide you with Minutes to your 2020 meeting with Chief and Council. I will circle back to the council secretary and request the minutes again. The land is registered as “band land” and therefore the Nation had the right to log and did not require “permission” from the family. This was not a malicious move and once the conflict was brought to the attention of leadership and PDG, I believe they decided to move the operation at that time, to provide certainty to the project. At this time, we cannot evict the current Snuneymuxw member who is residing at the adjacent property. The file containing the decades worth of information is large and we are diligently reviewing all the information.

Due to the complexity of the file, the Nation cannot just allot the Certificate of Possession to your family.  A few of the administrative hurdles we face are:

  • An outstanding BCR ceasing all allotments of CP’s (this has been in place since 1989.)
  • Under ISC land Management rules, the Nation cannot transfer land that is land locked or not accessible by public road(s). Technically, Clifford road is not a public road. It’s a private parcel of land owned by another family.
  • There is evidence that more that one family was present on the 5-acre parcel.

We are doing our very best to move this file along to a decision. We ask for grace as there is only me and one other person in the lands department. We have many things on the go, but this matter is important to your family, and I work on it frequently, to bring this file to a resolution. If you wish to talk, please suggest a date a time and I will block it off in my calendar.
